All content included in or made available through any Mobile Application or the Time Ahead Service, such as text, graphics, logos, button icons, images, digital downloads, and data compilations is the property of Time Ahead or its content suppliers and protected by United States and international copyright laws.
License and Access
This license does not include any resale or commercial use of any Time Ahead Service or Mobile Application, or its contents; any derivative use of any Time Ahead Service or Mobile Application or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Time Ahead without express written consent. You may not use any meta tags or any other “hidden text” utilizing our name or trademarks without the express written consent of Time Ahead. You may not misuse the Time Ahead Services or Mobile Applications.
You may use the Time Ahead Services and/or our Mobile Applications only as permitted by law. The licenses granted by us terminate if you do not comply with these Terms of.
We may collect and store information that is considered Personally Identifiable Information (“PII”), such as your name, address, email address, phone number, company name, access keys, API tokens, cookies and credit card details, in order for us to provide our Services. We may also collect potentially personally identifiable information such as Internet Protocol (or “IP”) addresses. We may also collect information about the Mobile Applications you use, to provide support now or in the future. Such details include but are not limited to device information, log information, cloud access keys, cookies, clicks, analytics tracking, support interactions and any other information available through cloud APIs or information made available by you to perform services of Company’s products and applications. We may also use such data for publishing aggregated reports, marketing promotions and research at our sole discretion, without personally identifying any User.
We may employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes.
We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. We reveal only the last four digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing. Our Mobile Applications and the Time Ahead Service is not directed to children under the age of 13. Our Users must not be under the age of 13. We do not target any portion of our service to children under the age of 13, and we will delete any accounts or data of Users that we believe to be under the age of 13 to be in compliance with the Children’s Online Privacy Protection Act. TIME AHEAD DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, REGARDING AND SUCH CONTENT AND YOUR ABILITY OR INABILITY TO USE TIME AHEAD SERVICE. YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY THAT THE MOBILE APPLICATIONS OR THE TIME AHEAD SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, THAT THE CONTENT WILL BE SECURE OR NOT OTHERWISE LOST OR DAMAGED, OR ANY IMPLIED WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, OPERABILITY AND ANY WARRANTY ARISING OUT OF ANY COURSE OF PERFORMANCE. USE OF ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR DATA THAT RESULTS FROM THE USE OF THE SERVICES OR THE DOWNLOAD OF ANY SUCH MATERIAL. Limitation of Liability
USE OF OUR MOBILE APPLICATIONS AND THE TIME AHEAD SERVICES OR THEIR CONTENT IS AT YOUR SOLE RISK. TIME AHEAD WILL IN NO EVENT BE LIABLE TO YOU OR ANY PERSON OR ENTITY CLAIMING THROUGH YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES UNDER ANY THEORY OF LOW FOR ANY ERRORS IN OR THE USE IF ON INABILITY TO USE TIME AHEAD SERVICE INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, BUSINESS, DATA, OR DAMAGE TO ANY COMPUTER SYSTEMS, EVEN IF YOU HAVE ADVISED TIME AHEAD OF THE POSSIBILITY OF SUCH DAMAGES.
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS TIME AHEAD AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES FROM ANY AND ALL CLAIMS (I) ARISING OUT OF YOUR BREACH OF ANY OF THESE TERMS AND CONDITIONS, AND ANY OF YOUR ACTIVITIES CONDUCTED IN CONNECTION WITH THIS SITE.
Changes to the Mobile Applications and the Time Ahead Services
We may, at our discretion, change the features of our Mobile Applications and the Time Ahead Service. You agree that we shall not be liable for any loss arising from such changes.
This Agreement and all acts and transactions pursuant hereto and the rights and obligations of the parties hereto shall be governed, construed and interpreted in accordance with the laws of the State of California, without giving effect to principles of conflicts of law.
International Data Transfer
Information that we collect or receive may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you’re located outside the United States and choose to provide information to us, we may transfer your information to the United States and process it there (or any other country in which we operate). We will agree to reasonably comply with all of the privacy statutes of countries within which you reside including the European Union.
